1. Who we are

The seller is ReefReport, ABN 18 908 905 151 (“ReefReport”, “we”, “us”). You can contact us at support@reefreport.com.au.

2. What a ReefReport is

A ReefReport is a screening snapshot of publicly available planning information for one address, as at the date and time shown on the report. It covers things like the planning zone, overlays, hazards, site geometry and height limits, and sets out what they may mean for building, extending or developing.

3. What a ReefReport is not

A ReefReport is not:

• a town planning report, and it is not for lodgement with council;
• planning, legal, financial, surveying or other professional advice;
• a title search, or a check of covenants, easements or other title matters;
• a valuation.

4. Check before you act

Do not rely on a report alone to buy, sell, design, build or lodge anything. Before you act on anything important you should:

• confirm it with the relevant council, a registered town planner or another qualified professional; and
• check the certificate of title and the Section 32 for covenants and easements.

At checkout you are asked to confirm: “I understand this is a screening snapshot, not planning advice or a town planning report, and I'll confirm anything important with council or a qualified professional before relying on it.”

5. Analysis is automated

Sections of a report labelled “Analysis” are produced automatically with the help of AI, using the planning data and clause text we retrieved for your address. They are not reviewed by a person before you receive them. They may be incomplete or wrong. Screening items marked “Worth checking” because a check couldn’t be run, and items marked “None recorded” against a partial dataset, are not a finding that nothing applies.

6. Data sources and currency

Reports are built from government and other public datasets, including Vicmap spatial data, the Victorian Planning Provisions and local planning schemes, and Australian Bureau of Statistics data. Those datasets can be out of date, incomplete or inaccurate, and planning controls can change after a report is produced. A report reflects those sources only as at its timestamp. We do not guarantee that any field is complete, current or error-free.

A paid report is a fixed record: we do not change it after it is produced, even if the underlying data later changes. A refresh is a new, separately dated report on the same address. If we find a material error in a report we may flag it and withdraw access to it, and will resupply or refund as set out below.

7. Buying a report

• Reports are sold per address. The price is shown at checkout in Australian dollars and includes GST. A tax invoice is emailed after payment.
• Payments are processed by Stripe. We check that your address, parcel and zone resolve before asking for payment.
• Each account can hold one full-price report per address. To get an up-to-date read on an address you already own, buy a refresh.
• Paid reports stay in your account. You need an account, and you are responsible for keeping your login secure.

8. Refunds

Every paid order has a 7-day money-back guarantee, no questions asked. This is on top of your remedies under the Australian Consumer Law. The details are on our Refund Policy, which forms part of these terms.

9. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law and that cannot lawfully be excluded, restricted or modified. If a clause in these terms would do that, it does not apply to that extent.

10. Limitation of liability

To the extent permitted by law, and subject to section 9:

• our total liability to you in connection with a report or these terms is limited to resupplying the report or refunding the price you paid for it; and
• we are not liable for any indirect or consequential loss, including loss of profit, loss of opportunity or loss arising from a decision to buy, sell, design, build or lodge in reliance on a report.

11. Acceptable use

You may not scrape ReefReport, resell report data in bulk, or try to get around payment or the one-report-per-address rule. We may suspend an account that does.

12. Availability

We aim to keep ReefReport available but do not promise it will be uninterrupted or error-free. If you pay and we cannot deliver your report because of an error on our side, we will re-run it or refund you.

13. Privacy

How we handle personal information is set out in our Privacy Policy.

14. Changes to these terms

We may update these terms. The date and version at the top of this page show when. The terms in force when you buy a report apply to that purchase, and we record the version you accepted against your order.

15. Governing law and disputes

These terms are governed by the law of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria. If you have a concern, please contact us first at support@reefreport.com.au so we can try to sort it out.
